Chị M là công nhân của xí nghiệp may mặc phụ trách phần đứng máy, chị đang mang thai tháng thứ bảy. Gần đây, để đảm bảo thực hiện hợp đồng dịch vụ may xuất khẩu mà công ty đã ký kết với đối tác nước ngoài, lãnh đạo công ty quyết định huy động toàn bộ 100% công nhân đi làm thêm giờ, làm ca đêm, trong đó có cả chị M. Vậy quyết định của lãnh đạo công ty đối với trường hợp của chị M là đúng hay sai? Theo quy định của pháp luật lao động chị M có được hưởng sự ưu tiên nào không?

 Theo Điều 115 Bộ luật Lao động năm 2002, người sử dụng lao động không được sử dụng người lao động nữ có thai từ tháng thứ bảy hoặc đang nuôi con dưới 12 tháng tuổi làm thêm giờ, làm việc ban đêm và đi công tác xa.
Người lao động nữ làm công việc nặng nhọc, khi có thai đến tháng thứ bảy, được chuyển làm công việc nhẹ hơn hoặc được giảm bớt một giờ làm việc hàng ngày mà vẫn hưởng đủ lương.
Căn cứ vào những quy định trên thì quyết định của lãnh đạo công ty đối với chị M là sai. Chị cần được hưởng chế độ ưu tiên để đảm bảo sức khoẻ sinh sản và chế độ thai nghén khi chuẩn bị sinh cháu bé.
